Lithuania: Questions related to tax obligations

The Commentary on the Law on Tax Administration was supplemented regarding the determination of the tax obligation according to the previous tax return.

If a company does not submit a tax return, the tax administrator has a right to establish a tax obligation according to the amount of tax that has been declared in the last submitted tax return. The obligation can only be established if the tax return is not submitted in time. The determination of the tax obligation cannot be applied to companies that are bankrupt or being liquidated.

The tax obligation established by the tax administrator is recognized as declared on the last day of the period. The default interest starts to be calculated, the actions of the recovery are performed and other rules of tax obligation fulfillment are applied for the established obligation.

The tax administrator has a right to perform a tax investigation for the period for which the tax obligation has been determined by the decision of the tax administrator. In such a case, the obligation established by the tax administrator is not assessed and the tax is considered as not declared.Alessandro Pasut
